The Affordable Care Act is driving ever-increasing rates of consolidation in the healthcare industry. But even as hospitals and health systems explore new agreements, they must also weigh potential antitrust scrutiny from the Federal Trade Commission. “It’s essential for acquisition planning to include a realistic assessment of any antitrust risk that the transaction may encounter,” said Simowitz. During this concurrent session, the panel reviewed recent high-profile antitrust cases, highlighted deals most likely to attract antitrust attention, and provided their predictions for the coming year and beyond.
